It didn't work out as hoped but I found a solution.
The content disappeared while I put the VML in a <table> or <td>.
So as a solution and because I needed the background VML on the header, I just put the VML as the first thing behind the <body> tag.
It worked and nothing disappeared. Hopefully, I can save someones day with this. Took me a long time.
